The legal system is becoming increasingly reliant on technology, even more so since the COVID-19 outbreak. Many clients are not only having to rethink how they conduct business and their daily lives, but also wondering what kind of impact the restrictions on their movements will have on upcoming mediations. Each case is built around the needs of particular clients. In principle, there really shouldn’t be any need to postpone a mediation simply because parties can’t be present in precisely the same location. Not to mention, travel times and costs in travel can sometimes be prohibitive.
How does remote mediation work?
We can actively engage all involved parties for mediation via telephone communication, email, or video conferencing platforms. There are already several forms of software that already exist specifically for purposes like this and are easily accessible to any party involved in mediation. Multiple people can ‘attend’ the mediation at precisely the same time through most any broadband internet connection in a home or office.
Mediation may also be conducted separately with parties receiving equal time. Remote mediation may be conducted in on scheduled sitting or as project mediation over a period of time. Options for assistance with document preparation are available.
Key benefits of Remote Mediation
Cost-Effective. Remote mediation can save immensely on the cost of travel, meeting rooms, refreshments, meals, etc. In some circumstances, remote mediations can be quicker than physical meetings as parties can move through background issues more quickly. Basic document preparation is also available.
Is Remote Mediation right for you?
Remote mediation is always tailored to the client and particular circumstances of each case. With a skilled mediator, a good internet connection and preparation, there’s no reason to postpone mediations solely on the grounds of sessions needing to be handled remotely. Any party concerned with the practicalities involved with remote mediation should seek further guidance from their mediator or attorney.
